China to Implement Strict Regulatory Environment for Online Drug Sales

The State Administration for Market Regulation (SAMR) recently promulgated《Measures for the Supervision and Administration of Online Drug Sales》(Order of the State Administration for Market Regulation No. 58), which will take effect as of 1 December 2022.

SAMR and Chinese Food and Drug Administration (CFDA) formulated《Measures for the Supervision and Administration of Online Drug Sales》to implement a series of policy decisions and refinements, aligning with the pharmaceutical administration law of the provisions of the drug sales network, to ensure the public's drug use safety and protect legitimate rights and interests of drug buyers. 

The Measures consist of six chapters and 42 articles, which stipulate the management of online drug sales, platform responsibility fulfillment, supervision and inspection measures and legal liabilities. 

The main contents include: 1) the principal responsibility of drug distributors should be implemented; 2) the responsibility of drug online sales platform should be strengthened; 3) the prescription drug online sales management should be clarified; 4) the "four strictest" requirements should be implemented and the supervision measures of regulatory departments at all levels should be strengthened.
